KochChat Terms of Service

Welcome to KochChat— your AI cooking companion. These Terms explain how you may use our website. By using KochChat, you agree to these Terms. If you don't agree, please don't use the service.

1. Who we are

KochChat is an independent service operated by Oleksandr Marchenko("we", "us"), based in Switzerland. For questions, contact support@kochchat.com.

2. Eligibility

You must be at least 16 years old to use KochChat. By using the service, you confirm that you meet this requirement.

3. What KochChat does

KochChat uses AI (currently Anthropic Claude as the primary provider, with the OpenAI API available as a fallback) to provide cooking tips, ideas, and general kitchen guidance. AI outputs can be inaccurate or incomplete. Always verify important details and use your own judgment.

  • Check food temperatures with a thermometer.
  • Review labels and watch for allergens yourself — do not rely solely on AI output.
  • Follow appliance manuals and standard food-safety guidance.

You use KochChat at your own risk.

4. Accounts

  • Sign in uses your Google account via Clerk. Keep access secure.
  • You're responsible for activity under your account.
  • Tell us promptly if you suspect unauthorized access.

5. Your content and AI outputs

  • You own the text prompts and chat messages you send ("User Content").
  • You grant us a non-exclusive, worldwide, royalty-free license to host and process your User Content only to operate KochChat.
  • AI outputs:subject to our underlying AI providers' terms, we assign to you all rights we may have in the AI-generated text (recipes, suggestions, shopping lists) produced in response to your prompts, so you may use it for your personal cooking. AI outputs may be similar across users; we make no guarantee of exclusivity or originality. The KochChat code, design, branding, UI, and platform itself are not licensed to you under this section — see Section 7.
  • Don't use KochChat for illegal, harmful, or infringing content. We may remove content or suspend access if these Terms are violated.

6. Acceptable use

  • No spamming, scraping, probing, or attacking the Service.
  • No illegal activity, hate, harassment, or abuse.
  • No copying, reselling, or reverse-engineering the Service.

7. Intellectual property

All KochChat code, design, branding, trademarks, and the Service itself remain the property of KochChat and its licensors. Nothing in these Terms grants you a right to use our trademarks or proprietary materials beyond the limited licence to use the Service as described.

8. Third-party services

KochChat relies on trusted providers including Anthropic and OpenAI (AI responses), Clerk (authentication), Supabase (data storage), Vercel (hosting), and Stripe(payment processing). Their terms apply separately and may change or become unavailable; we're not responsible for their services.

9. Privacy

Please read our Privacy Policy for details about what we collect, how we use it, retention, security, international transfers, and your rights. By using KochChat, you agree to that policy.

10. Subscriptions, payments & refunds

  • Auto-renewal: paid subscriptions are billed in advance and renew automatically for successive periods (monthly or annually, as selected at checkout) at the then-current price, until you cancel. Stripe processes the payment.
  • Cancellation: you can cancel at any time in Settings → Account. Cancellation takes effect at the end of the current billing period; you keep access until then.
  • Refunds: outside of mandatory consumer rights, we do not offer refunds or credits for partial subscription periods, unused features, or mid-cycle cancellations.
  • EU/EEA & Swiss consumers — right of withdrawal: if you are a consumer in the EU/EEA or Switzerland, you have a statutory right to withdraw from a paid subscription within 14 days of purchase. By starting to use a paid feature during this period, you may expressly agree to immediate performance and acknowledge that you lose your right of withdrawal once the service has been fully performed. Where the right of withdrawal still applies, we will refund payments without undue delay. To withdraw, email support@kochchat.com.
  • Nothing in this section limits any non-waivable consumer rights you may have under applicable law.

11. Changes, availability & beta

  • KochChat is in alpha/beta; features may change, break, or be removed at any time.
  • We may update the Service and may have occasional downtime for maintenance or technical reasons.
  • Uninterrupted availability is not guaranteed.

12. Ending your use

  • You may stop using KochChat at any time and delete your account in Settings → Account.
  • We may suspend or terminate access for violations of these Terms or for legal, security, or operational reasons.

13. Indemnification

To the extent permitted by applicable law, and except where you act as a consumer and mandatory consumer-protection law provides otherwise, you agree to indemnify and hold KochChat and its operator harmless from third-party claims, damages, or expenses (including reasonable legal fees) arising from your User Content or your violation of these Terms or applicable law.

14. Disclaimer & limitation of liability

No warranties:KochChat is provided "as is" and "as available." We do not guarantee accuracy, reliability, or error-free operation.

Limitation of liability: to the maximum extent permitted by law, we are not liable for any indirect, incidental, consequential, special, or exemplary damages, or for lost data or business, arising from or relating to your use of the Service.

Mandatory rights preserved: nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, for fraud, for gross negligence or willful misconduct (Swiss CO Art. 100), or any non-waivable statutory consumer rights.

15. Governing law & jurisdiction

These Terms are governed by Swiss law, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods. Courts in Zurich, Switzerlandhave exclusive jurisdiction, unless a different forum is required by mandatory law (including mandatory EU consumer-protection rules, which preserve consumers' right to bring proceedings in their country of residence).
